At the March term, 1902, of the circuit court of Sangamon county appellants began an action of assumpsit against appellee to recover upon a benefit certificate issued by the Covenant Mutual Benefit Association upon the life of one Hiram O. Bolles. The case was tried in the circuit court without a jury and judgment rendered in favor of the plaintiffs for the amount named in the certificate, ($5000,) less certain credits amounting to $2216, and for costs of suit.
