On November 12, 1998, Patty E. Lowery filed, in the Colbert County Circuit Court, a complaint seeking a divorce from Edward Oneal Lowery. The wife also sought custody of the parties’ two children, a son, age six, and a daughter, age two. The parties had entered into an agreement before the wife filed her complaint. On November 22, 1993, the trial court entered a judgment of divorce, ratifying, approving, and incorporating the agreement of the parties.
