The record in this case brings before us the validity of certain proceedings of the commissioners of highways of the town of Allen, in McLean county, in vacating a certain public road and locating and laying out a new public road in said town, under one petition, by certain land owners of said town. The records of the proceedings of the commissioners concerning said road were brought before the Circuit Court of McLean County by writ of certiorari, on the verified petition of appellees, Elihu Bozarth and Luther Brining, who own land adjoining the road vacated and near the new road, and who…
