MEMORANDUM AND ORDER

This matter is before the court on defendant’s motions to dismiss. The questions presented are: (1) whether the language of 20 V.I.C. § 493(a)(1), “... under the influence of an intoxicating liquor ...”, is unconstitutionally vague and/or ambiguous; and (2) whether defendant’s right to a speedy trial was violated, pursuant to this *246jurisdiction’s adoption of the Sixth Amendment right to a speedy trial? For the reasons stated below, the court concludes that the statute is not unconstitutionally vague, but that the defendant’s right to a speedy trial has been violated.
