The defendants were charged by indictment with entering into an agreement and accepting a sum of money for the grant of the sole privilege of selling and delivering ice to persons occupying an apartment house about to be erected by the defendants, in violation of section 861, subdivision 2, of the Penal Law (as added by Laws of 1917, chap. 702) which subdivision reads as follows: “ Any person who shall, directly or indirectly, either as the owner of such apartment house or tenement, or as an agent, employee or servant of such owner, accept any *500money, property or thing of value for permitting…
