LA BUY, District Judge.

The information filed herein charges a violation of Section 506 of the Federal Communications Act of 1934, as amended, 47 U.S.C.A. § 506. It charges that the licensee of radio station WAAF, located in Chicago, Illinois, for several years to on or about May 28, 1946, employed certain persons who were sufficient and adequate in number to perform all of the actual services needed by said licensee in connection with the operation of its radio broadcasting facilities; that notwithstanding the premises, the defendant, James C.
