Appeal from an order of the Family Court of Tioga County (Squeglia, J.), entered January 26, 1994, which granted petitioner’s application, in a proceeding pursuant to Family Court Act article 3, to adjudicate respondent a juvenile delinquent.
In July 1993, respondent was charged with an act which, if committed by an adult, would constitute the crime of menacing in the third degree (Penal Law § 120.15), a class B misdemeanor, and with possession of a weapon by a person under the age of 16 (Penal Law § 265.05).
