The defendant, Mario A. Godina, Jr., was convicted by a jury of the offense of second-degree murder. The defendant was sentenced to six years’ imprisonment. He appeals. We reverse and remand for a new trial.

Mario A. Godina, Jr., Jose Rojas, Francisco Anguiano, and David Scroggins were all indicted for first-degree murder in the death of Denny Reyes. The indictment alleged that they killed Denny Reyes on February 21, 1990, without lawful justification by shooting him with a gun, knowing that such act created a strong probability of death or great bodily harm to Reyes.
