R. E. Barfield, defendant in error (hereinafter referred to as the plaintiff), brought a suit against Harford Mutual Insurance Company, plaintiff in error (hereinafter referred to as defendant), on a draft, a copy of which is attached to the petition. The petition alleges that the defend*267ant drew a draft payable to the order of the plaintiff and one Lewis M. Elkins and delivered the same to the plaintiff.
