This case was appealed to this court to the October Term, 1935. An opinion was filed on February 10, 1936, in which we reversed and remanded the case for a new trial. We held that the first four counts of the declaration did not state a cause of action. The fifth count of the declaration charges that a fire was started through the negligence of the railroad company’s employees, and since the right of way of the defendant company was covered with dry grass and weeds, the fire spread to the warehouse of the plaintiff, which, with its contents, was greatly damaged.
