ORDER
DOTY, District Judge.
This matter is before the court upon defendant Midwest Stihl’s motion for sanctions pursuant to Federal Rule of Civil Procedure 11. After a review of the file, record and proceedings herein, and for the reasons stated, the court denies defendant’s motion.
BACKGROUND
Prior to September 8, 2006, plaintiff R & A Small Engine, Inc. (“R & A”) voluntarily dismissed all claims in this action filed by Roger Sirois in his personal capacity as well as R & A’s Heavy and Utility Equipment Dealer Act and negligent infliction of emotional distress claims.
