— Appeal from an order of the Supreme Court at Special Term (Dier, J.), entered October 15, 1981 in Schenectady County, which, inter alia, denied defendant Behrens’ cross motion to dismiss the complaint for failure to state a cause of action and for lack of subject matter jurisdiction. William Sweets was employed by the General Electric Company in Schenectady, New York, from approximately 1954 until his death on October 31, 1980, and while employed there, he enrolled in various employee benefit programs.
