This is the second appeal of this case. The first one is found in 233 Ky. 523, 26 S. W. (2d) 48. The first judgment in this case was reversed for reasons stated in that opinion. Upon a return to the circuit -court, the appelleefiled an amended petition, in which he averred the appellant was indebted to him for labor performed and money and material furnished in the sum of $3,365.
