This is an action on the case by the administrator of the estate of Hanford Kidney. Plaintiff’s intestate was instantly killed in a collision between an automobile in which he was riding, and defendant’s train, at Parsons Crossing, so-called, in the town of Presque Isle, on the 30th of September, 1918.

At the conclusion of the evidence the defendant’s counsel moved for a directed verdict, which was ordered by the presiding Justice, and the case is before the court on plaintiff’s exceptions to such order. We think the exceptions must be overruled.
