The question which naturally presents itself in the outset of this controversy is, whether the defendant has sc far committed himself by signing the undertaking set out ii the case, as to be unable to retract; or whether, as is insistid in-his behalf, it was necessary for him to subscribe the artices of association in order to bind himself to the payment of his subscription.
