(dissenting) — While engaged in extrahazardous work in the employ of Defiance Lumber Company, I. C. Lane sustained an injury in January, 1927, for which he was allowed compensation by the department of labor and industries and his claim was closed by a departmental order February 28, 1927, from which he did not appeal. Lane applied, January 26, 1943, to the department for a reopening of his claim on the ground that his disability had become aggravated since his claim was closed.
