-This case was tried by the court without a jury, and by request of the parties a special finding- of facts was made in accordance with section 3320 of the Code.
*254We are, therefore, confined in. our consideration solely to the question whether the facts as found are sufficient to support the judgment. • We cannot enquire, as counsel for both parties seem to think, into the correctness of the finding of the facts, although the record contains a bill of exceptions setting out in extenso the evidence upon which the trial court based its findings. — Chandler v.
