Appeal from an order of the County Court of Sullivan County (LaBuda, J.), entered January 5, 2012, which granted defendant’s motion to dismiss the indictment.

In June 2011, defendant was charged by indictment with grand larceny in the third degree (one count) and falsifying business records in the first degree (16 counts), in connection with the receipt of $6,551.25 in unemployment benefits during a time when she was actually employed and earning income.
