The defendant Ireland was engaged in the coal, ice, general hauling and contractors’ supply business in the Borough of Aspinwall. He entered into an agreement with the plaintiff for the sale of the equipment incident to the business together with the good will. The contract provided that the defendant and his wife should not for a period of five years, engage in such business within the borough.
