The defendant was indicted by the grand jury of Richardson county for the crime of burglary, by breaking into the B. & M. railroad station at Humboldt. On the trial of the cause the court instructed the jury as follows :, “Gentlemen of the jury — You are directed to return a verdict of acquittal in this cause, for the reason that the evidence is too clear that this man Bayliss was under the direction of the railroad company’s agent, when he was pretending to be in collusion with this defendant, and going with him to commit this crime.
