Appeal by the defendants from an order of the Supreme Court at Special Term in Albany County denying a motion to vacate an order granting summary judgment to the plaintiff and for leave to serve an amended answer. Plaintiff brought this action to recover the sum of $9,500 for legal services alleged to have been rendered for the defendants and for which defendants agreed to pay.
