People v. Kelly
Appellate Division of the Supreme Court of the State of New York
1Opinion of the Court
—Appeal by the defendant (1) from a judgment of the Supreme Court, Westchester County (Rosato, J.), rendered April 5, 1989, convicting him of robbery in the first degree (two counts) and attempted robbery in the first degree, upon a jury verdict, and imposing sentence, and (2) by permission, from an order of the same court, dated September 26, 1990, denying his motion pursuant to CPL 440.10 to vacate the judgment of conviction. The appeal brings up for review the denial, after a hearing, of that branch of the defendant’s omnibus motion which was to suppress identification testimony.
