Jessie Giersch recovered a judgment for the death of her husband incurred while employed as a switchman by the defendant company as a result of being crushed between two freight cars in the defendant’s yards at Emporia. The defendant appeals and error is assigned upon the rejection of certain evidence, the overruling of a demurrer to the plaintiff’s evidence, in giving and refusing instructions and in denying a motion to set aside certain special findings, a motion for judgment on the special findings and a motion for new trial.
