McHUGH, Justice:

This case is before this Court upon the petition of Ronnie R. Justice for a writ of habeas corpus. It arises from an order entered on April 29, 1985, by the Circuit Court of Mingo County in which the petitioner was sentenced to an indeterminate-period of not less than one nor more than ten years. The petitioner was convicted of voluntary manslaughter, and he was given a five-year sentence enhancement imposed pursuant to the West Virginia Habitual Criminal Statute. W.Va.Code, 61-11-18 [1943].
