MAUS, Chief Judge.
The defendant was charged as a second offender with having committed burglary and stealing on September 26, 1976. He was found guilty by a jury and sentenced by the court to 10 years’ imprisonment for burglary and five years’ imprisonment for stealing, the sentences to run concurrently. The defendant does not question the sufficiency of the evidence. His two points on appeal are based upon the lapse of time between the time he was charged and the time he was tried.
