DAVIDSON, Presiding Judge.

Appellant was convicted of aggravated assault and battery, his punishment being assessed at a fine of $100 and imprisonment in the county jail for six months.

As usual, in cases of this sort, the evidence is in conflict and presents divergent views to be considered by the jury under appropriate instructions of the court. The witness and alleged assaulted party, Greer, testified that he and appellant live about a mile apart and about five miles from the city of Marshall.
