Proceeding pursuant to CPLR article 78 (transferred to this court by order of the Supreme Court at Special Term, entered in Albany County) to review a determination of the Comptroller which denied petitioner’s application for accidental disability retirement. Petitioner was employed as a correction officer at the Ta-conic Correctional Facility, Bedford Hills, New York. On February 2, 1976, he fell from a swivel chair and sustained an injury which he contends left him permanently disabled.
