HALE, District Judge.
In this action of trqver the plaintiff seeks to recover the value of 4,000 tons of ice, alleg'ed to have been willfully and intentionally converted by the defendant to its own use, at New York City, on the 9th day of August, 1906. The plea is the general issue. The parties have filed a written stipulation, waiving a jury.
