— Entertaining the opinion we do, it will be unnecessary to consider all the points which have been pressed upon us in the arguments of the counsel. This was an action of ejectment, to recover a tract of land of one hundred and eleven acres and twenty-two perches, in the possession of the defendant. The property in question, was part of the estate of John Muntorf, the elder, and as such, descended to his heirs; and was taken at the appraisement by John Muntorf, who entered into a recognisance on the 17th of January, 1823, to pay to the…
