Plaintiff Derek I. Tolbert appeals from a final judgment of the United States District Court for the Eastern District of New York, Bernard A. Friedman, Judge*, dismissing as a matter of law his claim that defendants Queens College of the City University of New York (“Queens College” or the “College”), Stuart Liebman, and Helen Smith Cairns (collectively “defendants”) discriminated against him on the basis of race.
