Appellant appeals from a trial-court order denying his motion for post-conviction DNA testing. Appellant was convicted of capital murder and sentenced to death. On direct appeal, we affirmed his conviction and sentence. Leal v. State, No. 72,210 (Tex.Crim.App., delivered February 4, 1998)(not designated for publication), cert. denied, 525 U.S. 1148, 119 S.Ct. 1046, 143 L.Ed.2d 53 (1999). In 2008, appellant filed a motion for DNA testing of evidence pursuant to Chapter 64 of the Code of Criminal Procedure.…
