Gische, J.), entered August 13, 2010, which denied the petition seeking to annul the determination of respondent State of New York Division of Housing and Community Renewal (DHCR) denying petitioner’s application to deregulate a rent-stabilized apartment pursuant to the high-income rent decontrol provisions, and dismissed the proceeding brought pursuant to CPLR article 78, unanimously affirmed, without costs.
