This is an appeal from a dismissal of a petition for the writ of habeas corpus. Petitioner seeks a ruling on the merits of his petition as well as a decision by this Court on the question of whether or not a prisoner has a right to bail while appealing a dismissal of a habeas corpus petition.

The petitioner was convicted on May 17,1963, of fraudulent breach of trust in the Criminal Court of Hamilton County, Tennessee.
