The question involved in this case, while by no means one of first impression, is historically interesting by reason of the fact that in its determination, the Court of Appeals of this *432State unanimously reached one conclusion ( Uravic v. Jarka Co., 252 N. Y. 530), while the United States Supreme Court, with equal unanimity, attained a diametrically opposed result (282 U. S. 234). (See, also, Matter of Taylor, 204 N.
