Justice Brown as decides that any cause of action is shown, either in the pleadings or proof, against defendant. I concur with .so much of the opinion as decides that, in any point of view, the defendant could be liable only for actual damages. I have given to the case my most careful and anxious c.onsideration and investigation, because of the divergent views of the Judges and the far-reaching effect of the holding upon the liabilities of all of our citizens in their business and industrial life.
