The Commonwealth and the other complainants in these cases appeal from the dismissal of their bills in equity, through which they seek an injunction against defendants to prevent the discharge, by them, of acid mine waters into Indian Creek, in Fayette County. This stream is approximately 22 miles long, with a drainage area of about 130 square miles, and on it, at a point below defendant’s mines, one of complainants, the Mountain Water Supply Company, has constructed a dam with a capacity of 251,000,000 gallons of water, and a reservoir capable of holding…
