Tin's is an appeal from a judgment of the district court for Lancaster county sustaining a general demurrer to the plaintiff’s petition and dismissing his action. The *662only question presented for our determination is: Does the plaintiffs petition state facts sufficient to constitute a cause of action?

The petition alleges, in substance, that the defendant is a city of the first class existing under and by virtue of the statutes of Nebraska; that defendant then having power and authority to let contracts for the construction of sidewalks within its corporate limits, and to levy and assess taxes…
