OPINION

PRICE, Justice.1

A jury convicted appellant of aggravated robbery; the trial judge assessed punishment at 45 years confinement.

In point of error number one, appellant asserts that the trial court erred in charging the jury on the second paragraph in the indictment when the State presented to the jury only the first paragraph, which had previously been abandoned by the State. The State claims that this matter was inaccurately recorded and that the record should reflect that the State properly presented to the jury the second paragraph in the indictment.
