MR. JUSTICE ADAIR:

(dissenting).

On June 23, 1954, the plaintiff, Shirley Barbour, procured an absolute divorce from the defendant, Charles Barbour, who is a carpenter by trade.

By the terms of the decree Shirley was awarded custody of the four minor children of the parties and $150 per month for their support; the defendant Charles was ordered to pay to the plaintiff for Shirley’s attorney a fee of $150 and it was *329adjudged that the plaintiff Shirley receive a one-half interest in the joint property of the parties wherever situate.

No appeal was taken from the above decree and judgment of divorce…
