Allen, J.: The plaintiff in error, as plaintiff below, brought this action against the railway company to recover damages claimed to have been caused by the negligence of the defendant's servants in the operation of its railway. The plaintiff was employed as a section-hand at Oafcley. On the 14th of September, *2291889, he was directed by the foreman under whom he was working to level cinders between the rails of the main track not far from the station at Oakley.
