Reversing.

The appellant and plaintiff below, Louis Snyder, is the father of the appellee and defendant below, J. E. Snyder. Plaintiff owned a farm containing about 140 acres in Oldham county, upon which he and his wife resided. Their children scattered and married; two of whom were residing in Florida and one of them was and is defendant. On December 5 of that year the wife of plaintiff died, and most of their children, including defendant, attended the funeral.
