Claimant appeals from a judgment of the Court of Claims which dismissed his claim for personal injuries against the State of New York on the merits. It was determined as a conclusion of law that the agents, servants and employees of the State were not careless or negligent; that the accident was caused *414by the negligence and carelessness of the claimant and that he had failed to prove facts sufficient to constitute a cause of action. The court refused to find that it had no jurisdiction of the claim.
