People v. Brown

Appellate Court of Illinois

Decided July 30, 1976No. 75-280PublishedCited by 23 opinions

1Opinion of the CourtJustice Stengel

F ollowing a jury trial defendant was found guilty of delivery of more than 30 grams but not more than 500 grams of cannabis and conspiracy to deliver cannabis, and was sentenced on the delivery conviction to a term of imprisonment for not less than one year nor more than three years. The issues presented by defendant’s appeal are whether defendant was deprived of the effective assistance of counsel at the sentencing hearing, whether the sentence is excessive, and whether the verdict for conspiracy should be reversed because that charge arose from the same conduct as the delivery of cannabis.
