This is an appeal from a decree of the probate court of the city of Providence granting letters of administration for the estate of Gertrude Miller to the defendant, Francis J. Maguire. The case is before this court on the plaintiff’s appeal from a judgment entered in the superior court granting the defendant’s motion for summary judgment and denying and dismissing the plaintiff’s appeal from the decree entered by the probate court.
