OPINION

YOCK, Judge.

This case is before the Court on cross-motions for summary judgment. For the reasons stated below, the defendant’s motion for summary judgment is granted, the plaintiff’s motion is denied, and the plaintiff’s complaint will be dismissed.

FACTUAL BACKGROUND

In this action, the material facts are not in dispute. The plaintiff, Cynthia Kennedy, found a $10,000 United States Treasury Note in April, 1985.1 The note was payable to the bearer and had an interest rate of 14 percent.
