Rosalsky, J.:

The defendant was convicted of a violation of article 7, subdivision 5, of the Public Hack Ordinance of the corporation of the city of New York, which provides as follows: “ No public hack, while awaiting employment by passengers, shall stand in *155any public street or place other than at or upon a public hack stand designated or established in accordance with this ordinance.”

Another subdivision of this artcle, which is applicable to the facts in this case, is section 3, which provides as follows: 66 The Mayor is hereby authorized to locate and designate as public hack stands such…
