OPINION

{¶ 1} This matter is before the Court on the Notice of Appeal of Roderick A. Smith, filed June 6, 2006. On January 3, 2006, a Clark County Grand Jury indicted Smith on one count of having weapons while under disability, in violation of R.C. 2923.13, a felony of the third degree, and one count of carrying concealed weapons, in violation of R.C. 2923.12(A)(2), a felony of the fourth degree.
