The sole question presented is, Was the mortgage sought to be canceled by the cross-bill given on the lands of the wife as security for the debt of the husband?
The case made by the evidence, without serious dispute, may be briefly stated as follows; Robert Rollings contracted with A. C. Gunter to sell him 40 acres of land for $2,-000. At first it was agreed upon as a cash deal. When preparing to close the deal A. C.
