This is a consolidated appeal from two orders of the bankruptcy court, Párente, J., entered on October 15 and 21, 1976.
The facts of this case are set forth in the Second Circuit’s opinion in Track Drivers Local 807 v. Bohack, 541 F.2d 312 (2d Cir. 1976). To provide a proper framework for our discussion, we will summarize briefly the salient events of the Bohack Corporation’s (“Bohack”) recent, troubled past.
