The defendant was convicted of the crime of forgery in the second degree. The gist of the offense was the unauthorized filling in of a blank check intrusted to him by his employers. The material facts, as testi*52fled to by the complainant, Oscar M. Crego, were these: Dickie was the cashier of the firm of Russell Crego & Son. As such cashier, he had been for two or three years intrusted with 12 checks, signed by the firm, and.payable to his own order, but undated and blank as to amount.
